This Privacy Policy ("Policy") is intended for clients of FHS EA Benefits s.r.o., with its registered office at Jankovcova 1569/2c, 170 00 Prague 7, Company ID No. 287 41 862, registered in the Commercial Register maintained by the Municipal Court in Prague, file no. C 316862 ("FHS"), and informs clients and other data subjects about what personal data FHS processes as controller, for what purposes and for how long, and about the rights of data subjects in connection with the protection of their data. This Policy has been prepared in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council ("GDPR") and applicable laws of the Czech Republic.

2. What Personal Data FHS Processes
2.1. FHS processes in particular the following categories of personal data: a) Identification data: name, surname, company ID (IČO), VAT number (DIČ), company name, registered office or permanent residence address. b) Contact details: e-mail, phone number. c) Billing and payment data: information needed to issue invoices, payment information. d) Communication data: records of e-mails, phone calls, contact form submissions. e) Technical data: IP addresses, cookies, device and browser information, pages visited.
3. Purposes and Legal Grounds for Processing
3.1. FHS processes personal data for the following purposes: a) Performance of the contract: Providing services and Benefits. b) Compliance with legal obligations: Issuing invoices, archiving accounting records. c) Legitimate interests: Improving services, ensuring the security of the Portal, asserting and enforcing FHS's rights and other claims arising from the contract. d) Based on consent: Marketing activities, use of cookies (see Article 6).
3.2. The legal grounds for processing are in particular Art. 6(1)(a), (b), (c) and (f) GDPR.
4. Disclosure of Personal Data to Third Parties
4.1. Personal data may be disclosed to the following recipients: a) FHS Partners, for the purpose of performing and providing services and Benefits under the contract. b) Providers of IT services, payment gateways, marketing tools and other technical services. c) Public authorities, in accordance with applicable law. d) Providers of mobile and other tools and applications in connection with the use of services and Benefits under the contract (e.g. Apple Wallet and Google Wallet).
4.2. Third parties may act either as processors of personal data acting on FHS's instructions, or as independent controllers of personal data. FHS makes every reasonable effort, within its expected means, to ensure that all data processors it engages comply with data protection rules in accordance with the GDPR. FHS will provide a list of data processors on request.
5. Data Retention Period
5.1. Personal data is retained for as long as necessary to fulfil the purpose of processing, but no longer than: a) 10 years from termination of the contract, in the case of accounting records. b) 1 year from the last interaction, in the case of marketing consent.
6. Use of Cookies
6.1. FHS uses cookies to improve the functionality of the Portal and to personalise content.
6.2. Cookies are used on the basis of legitimate interest (necessary cookies) or consent (analytical and marketing cookies). Further information is available in the relevant cookie banner.
7. Rights of Data Subjects
7.1. The Client has the right to: a) Access their personal data. b) Request correction or erasure of their data. c) Request restriction of processing and data portability. d) Lodge a complaint with the Office for Personal Data Protection, based at Pplk. Sochora 27, 170 00 Prague 7. e) Object to the processing of personal data carried out on the basis of FHS's legitimate interest under Art. 6(1)(f) GDPR. f) Withdraw consent to the processing of personal data at any time, where the processing is based on consent under Art. 6(1)(a) GDPR.
8. Final Provisions
8.1. This Policy may be updated unilaterally by FHS. Changes will be announced on the Portal.
8.2. The current version of this Policy is effective from 1 January 2025.
